An extract from the Unified State Register of Legal Entities! Individual Entrepreneurs and Public Organizations is not proper proof of self-representation in court for a legal entity

On February 22! 2024! the Supreme Court! as part of the panel of judges of the An extract from Cassation Administrative Court! in case No. 460/9301/23! administrative proceedings No. K/990/43836/23 (EDRSRU No. 117187469)! examined the issue of proper twitter data confirmation of self-representation in court for a legal entity.

In accordance with Part One of Article 5 of the Code

Administrative Procedure of Ukraine (hereinafter referred to as the Code of Administrative Procedure of Ukraine)! every person has the right! in accordance with the procedure established by this Code! to apply to an administrative court if he or she believes that a decision! action or inaction of a subject of public authority has violated his or her rights! freedoms or legitimate interests.

Part seven of Article 160 of the Civil Procedure Code of Ukraine stipulates that if a statement of claim is filed by a representative! it shall additionally contain the information specified in paragraph 2 of part five of this article regarding the representative.

Part one of Article 55 of the Code of Administrative Offenses of Ukraine establishes that a party

a third party in an administrative case! as well as a person who is granted by law the right to apply to the court in the interests of another person! may participate in the legal proceedings in person (self-representation) and (or) through a representative! except for the case established by Part nine clean email of Article 266 of this Code.

According to Part Three of Article 55 of the Code of Civil Procedure of Ukraine! a legal entity! regardless of the procedure for its creation! a subject of authority that is not a legal entity! participates in the case through its manager! a member of the executive body! another person authorized to act on its (his) behalf in accordance with the law! charter! regulations! employment agreement (contract) (self-representation of a legal entity! subject of authority)! or through a representative.
